TERMS & CONDITIONS

1. Definitions

• “Buyer” means a user who purchases goods through the site.

• “Seller” means a user who lists products for sale on the site.

• “Services” includes listing, sale, import, logistics, delivery, and related support.

• “Goods / Products” means the marine equipment, boats, engines, spare parts, etc., that are offered or sold.

• “GST Note Period” refers to the time during which Marinage Industries has not yet obtained its own GST registration.

 

2. Eligibility; User Accounts

• You must be at least 18 years old and legally capable to enter into contracts.

• You may need to register an account to use certain services (buying, listing, etc.).

• You agree to provide accurate, current, and complete information. You are responsible for safeguarding your account credentials.

 

3. Nature of Services & What We Provide

• Marinage is a marketplace and intermediary platform connecting Buyers and Sellers of marine products in India.

• We facilitate listing, order processing, logistics, import services, customs clearance, and final delivery.

• We do not manufacture products (unless explicitly stated) and do not always hold inventory.

 

4. Pricing, Taxes & GST Note

• All prices are in Indian Rupees (INR).

• As of now, Marinage is a newly formed entity and does not possess its own GST registration. Therefore, until we obtain GST:
    • Sellers must charge, collect, and remit GST (where applicable) in compliance with Indian tax laws.
    • Marinage will not issue a GST invoice on its own.

• Once we get our GST registration, we will assume the responsibility of charging or remitting GST in future transactions.

• Import duties, custom charges, port handling, and other fees are extra and will be clearly communicated before final billing.

 

5. Orders, Shipping & Imports

• Buyers place orders and pay fully in advance.

• For domestic shipments, delivery is expected in 7–10 business days.

• For imports, total delivery period (including sea freight, port clearance, local transport) may take 30–60 business days or more depending on customs delays.

• Marinage (or its agents) handles freight, customs clearance, and local delivery, subject to delays beyond our control (e.g. weather, customs, shipping lines).

• We will provide tracking and status updates where possible.

 

6. Returns & Refunds

• Cancellation allowed within 24 hours of payment confirmation, provided shipping or import has not yet begun.

• Products that are damaged or defective (and reported within a specified window) may be eligible for refund or replacement as per manufacturer warranty.

• Custom-ordered or imported items once shipped may not be eligible for refund.

• Refunds (if approved) will be back to the original payment method and processed within 7–10 working days after verification.

 

7. Seller-Specific Terms

• Sellers must provide accurate product descriptions, specifications, and truthful images.

• Sellers are responsible for GST (during the GST Note Period).

• Sellers must comply with import/export regulations, certifications, and safety norms.

• Marinage may charge commission or platform fees (as agreed separately).

• Marinage reserves the right to refuse, suspend, or remove listings or accounts in case of violations (fraud, counterfeit products, non-cooperation).

 

8. Intellectual Property

• All content on the site (text, logos, images, software) is owned by or licensed to Marinage.

• Users may not copy, distribute, reproduce, or create derivative works without express permission.

• If users upload any content (e.g. images for listings), they must hold the rights or license to do so and grant Marinage a license to use such content.

 

9. Suspension, Termination & User Conduct

• Marinage may suspend or terminate a user’s access or account at any time if the user violates these Terms or applicable law.

• User agrees to refrain from illegal use, spamming, hacking, or disruptive behavior.

• On termination, outstanding obligations (payments, deliveries) still stand.

 

10. Warranties, Disclaimers & Limitation of Liability

• We do not guarantee that the website will be uninterrupted, error-free, or secure at all times.

• Products are supplied by third-party sellers, so we do not warrant their perfection.

• To the maximum extent allowed by law, Marinage’s liability is limited. We are not liable for indirect, incidental, special, consequential damages (e.g. lost profit).

• In no event shall our total liability exceed the value of the transaction in question.

 

11. Indemnification

You agree to indemnify and hold Marinage (and its officers, agents, affiliates) harmless from any claims, losses, liabilities, damages, or expenses (including legal costs) arising from your use of the site, violation of these Terms, or your breach of obligations.

 

12. Changes to Terms & Your Duty to Review

Marinage reserves the right to change, modify, or update these Terms at any time. We will notify users of material changes by posting on the site or by email. Continued use after changes constitutes acceptance of the modified Terms. It’s your responsibility to review Terms periodically.

 

13. Governing Law & Dispute Resolution

These Terms are governed by the laws of India. All disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Howrah, Kolkata, West Bengal.
